1.2     TERMS AND CONDITIONS
This Agreement shall become effective and shall commence on the Utility Transfer Date (which shall be a meter read date within 90 days from the date of this Agreement) following such Agreement date and shall continue for [ ] months after commencement unless terminated pursuant to Agreement terms. This Agreement shall remain in effect until the expiration of the term unless otherwise agreed to by the Parties in writing and shall continue on a month to month basis thereafter. I authorize Discount Power® to switch my service and to become my retail electric provider.

UNDER THE MARKET RULES CUSTOMER HAS UNTIL MIDNIGHT OF THE THIRD BUSINESS DAY FOLLOWING SUCH IN WHICH TO PROVIDE NOTICE TO DISCOUNT POWER® THAT CUSTOMER ELECTS TO RESCIND, WITHOUT CHARGE OR PENALTY, THIS AGREEMENT. THIS AGREEMENT WILL NOT BECOME BINDING UPON DISCOUNT POWER® UNTIL COMPLETION OF A CREDIT CHECK OF CUSTOMER COMPLETELY SATISFACTORY TO DISCOUNT POWER®. IF THIS DOES NOT OCCUR, OR IF CUSTOMER DOES NOT PROVIDE THE CREDIT SUPPORT DISCOUNT POWER® REQUIRES, DISCOUNT POWER® WILL PROVIDE CUSTOMER WRITTEN NOTICE THEREOF WITHIN NOT MORE THAN FIFTEEN (15) BUSINESS DAYS FROM THE AGREEMENT DATE AND THIS AGREEMENT WILL BE VOID AND OF NO EFFECT, WITHOUT LIABILITY TO EITHER PARTY. MY CHOICE TO ELECT DISCOUNT POWER® AS MY RETAIL ELECTRIC PROVIDER IS NOT MANDATORY. I FURTHER UNDERSTAND THAT MY LOCAL UTILITY WILL CONTINUE TO TRANSPORT ENERGY, PROVIDE MAINTENANCE, READ MY METER AND RESPOND TO EMERGENCY SERVICE CALLS. I ACKNOWLEDGE THAT I SHALL RECEIVE A BILL FROM DISCOUNT POWER® FOR BOTH ENERGY AND UTILITY (TDSP) CHARGES. THIS AGREEMENT IS SUBJECT TO THE FINAL APPROVAL OF AN AUTHORIZED DISCOUNT POWER® OFFICER.

1.3     PRICING
The prices to be paid by Customer to Discount Power® for all electricity purchased hereunder shall be equal to the sum of (i) the Agreement price of energy multiplied
by your monthly kilowatt (kWh) usage, plus (ii) Monthly Customer Charge, (iii) TDSP charges (iv) applicable federal, state and local taxes, including GRT
reimbursement, as well as any fees or other amounts charged by a government entity.

Price per kWh excluding TDSP: Monthly Customer Charge: $6.95

1.4     CUSTOMER ACCEPTANCE
I am over 18 year of age and a legally authorized representative of this company “(Buyer)”. By signing below, I authorize Discount Power® to act as my authorized retail electric provider (REP) and act as my agent to handle this transition in coordination with the local utility to provide all required data as per market rules and protocols. I hereby acknowledge receipt and agree to the Terms of Service, Facts Label and “Your Rights as a Customer” Agreements that accompany this Agreement. This Agreement supersedes any other oral or written discussion concerning Discount Power® retail electric services. In addition, I understand that I personally and unconditionally guarantee any amounts owed to Discount Power® under this Pricing Agreement and Terms of Service
